Welcome to Dani Oliver Photography. Please read these Terms of Service ("Terms") carefully before using the website https://www.danioliver-photography.com/ (the "Site") or commissioning any photographic services. By accessing the Site or booking a session, you agree to be bound by these Terms.
1. Definitions
"Photographer": Dani Oliver, trading as Dani Oliver Photography.
"Client": The individual, business, or entity booking or purchasing services or goods.
"Images": All digital files, prints, or other media produced by the Photographer.
2. Bookings and Payments
Retainer/Deposit: A non-refundable booking fee or retainer is required to secure any session date (including portraits, weddings, events, travel, or street photography commissions). No booking is confirmed until this fee is received.
Payment Schedule: The remaining balance for services must be settled in full according to the schedule specified in the individual client contract or prior to the delivery of the final high-resolution images.
Cancellations & Rescheduling: Notice of cancellation or postponement must be provided in writing. Specific timelines regarding forfeiture of fees or rescheduling allowances will be detailed in your service contract.
3. Intellectual Property and Copyright
Copyright Ownership: The Photographer retains the entire copyright and all intellectual property rights in all Images created, at all times, throughout the world.
Usage Licence: Upon full payment, the Client is granted a personal, non-exclusive, non-transferable licence to use, download, display, and print the Images for personal, non-commercial purposes.
Commercial Use: Images may not be sold, licensed, or used for commercial advertising, marketing, or promotional purposes by the Client or third parties without explicit written consent and an additional commercial licensing fee from the Photographer.
Modifications: The Client must not alter, crop, manipulate, or apply digital filters to the final Images. All displays of images must maintain visual integrity as delivered, respecting the presentation standards outlined in the Dani Oliver Brand Guidelines.
4. Image Delivery and Storage
Delivery Timelines: Final edited digital images will be delivered via an online gallery link (such as Pixieset) within the timeframe specified in the project contract.
Curation: The Photographer reserves the right to select and edit only the best representation of work. Raw files or unedited proofs will not be provided under any circumstances.
Archiving: The Photographer will store the final delivered images for a limited period (typically 12 months from delivery). It is the Client’s sole responsibility to download and backup their digital images upon receipt.
5. Print Store and Fulfilment
Fulfilment Partners: Print orders placed through integrated online galleries are fulfilled directly by third-party laboratories (e.g., Loxley Colour).
Product Accuracy: Due to variations in monitor calibrations, the Photographer cannot guarantee that the colours on your screen will perfectly match the physical print, though the highest standard of professional calibration is maintained.
Shipping and Returns: Because all prints are custom-made to order, returns or refunds are not accepted unless the product arrives damaged or with a manufacturing defect, which must be reported within 7 days of delivery.
6. Creative Control and Conduct
Creative Licence: The Photographer shall be granted artistic licence in relation to the poses photographed, locations used, and digital editing style. The Photographer’s judgement regarding editing and composition is final.
Client Cooperation: The Client is responsible for ensuring the cooperation of guests or subjects at weddings and events. The Photographer is not responsible for missed images due to non-cooperation or severe schedule delays caused by the Client.
7. Limitation of Liability
Technical Failure: In the highly unlikely event of total photographic failure, equipment malfunction, injury, or illness beyond the control of the Photographer, liability shall be limited to a full refund of all monies paid by the Client for that specific session.
Consequential Loss: The Photographer is not liable for any indirect or consequential loss or damage arising from a failure to deliver images or services.
8. Governing Law
These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the English courts.
